Creating an Outcome That Builds Your Future

Family law cases mean decisions that impact the rest of your life. The family lawyers of Duxstad, Bestul & McNaughton help you move through this transition thoughtfully and help build a plan for the future.

Every family is unique, and there is no “one-size-fits-all “way to address your concerns. Just because something worked well – – or poorly – – for a friend, family member, coworker, that does not mean it will be a good fit for you.

The route you take to work through things has a huge impact on long term outcomes.  We want to help you find the path that works best for you, and so provide several options:

Limited Scope Representation / “Unbundling"

With unbundling, you and your lawyer agree that the lawyer will perform some, but not all aspects of the case, and you take care of all other parts of the case. This can take many forms, and it is not unusual for a “do it yourselfer” to bring a lawyer on board to help prepare or review documents, to answer questions, or to consult on court procedures or how to work through issues. This option means you to only pay for the help they need and can be much less expensive than traditional full scope representation.

Collaborative Representation

This is a form of limited scope representation, where you work with trained collaborative attorneys to reach an agreement on the issues they face. At the start of the collaborative process, the couple and the attorneys sign an agreement to negotiate until an agreement is reached, and that neither party will ask the court to decide any of their issues.

Mediation

Mediation is a confidential, problem-solving approach, using a neutral third party to facilitate. Your lawyer-mediator does not represent either of the parties, and cannot provide legal advice, but can educate and inform, guide discussions and draft and file the documents necessary to resolve the case. Mediation allows you create your own durable agreement that meet your unique needs.

Traditional Full Scope Representation & Litigation

This is the adversarial process, where you retain hiring an attorney to advocate on your behalf. Most cases – including traditional representation cases — end with an agreement, but if the parties can’t put one together, the judge conducts a trial makes the final decision.
